皇冠与刑法

——法律英语漫谈五十九

Crown是一个常用词。它的主要意思为“王冠”和“王权”。The Crown常用以指代国王、女皇或政府，如：Crown-lands or Crown property 是指王室领地或财产或国有房地产；Crown servant指王室官员或公务员；Crown

privilege是指由于国家利益，王室与政府无需向法院出示文件的特权；Crown

copyright是指王室或政府的版权；Crown agent 指王室代理人。因此，把Crown译为王室或皇家，好像是顺理成章的事。但在英国的法律英语里，Crown这个词，在很多场合里均指“刑事的”或“政府的”，而不应或不能再译成王室或皇家，尽管从字源意义上说，它的确与王权有关，如：

Crown cases在英国指“刑事案件”，不是王室案件。

Crown law指“刑法”，不是王室法。

Crown Court指英国的“刑事法院”，不是王室法庭。有的译为巡回刑事法院，因为它没有自己的固定法官。高等法院的任何法官、巡回法官或记录法官都可以在巡回刑事法院审理案件。它由一个巡回法官和陪审员组成，比治安法院高一级。但上诉案件或移送其量刑的案件，须与两至四名治安法官组成合议庭审理。

Crown witness指英国刑事诉讼中原告方面的证人，并非指王室证人。

Crownside指英国专门审理刑事案件的“公诉部”，或译为“刑事部”“刑事管辖权”，不可译为“王室方面”。

Crown Office指英国高等法院的刑事部、公诉署，不是皇家办公室。

Crown lawyer指“刑事律师”，他未必是皇家律师。但Crown solicitor或Crown advocate却指“御用律师”、“王室律师”或政府指派的律师。

Crown counsel指英国的“检察官”，而不是皇家顾问。（但Crown

Solicitor是指香港回归前香港律政署“民事检察专员”。）

crown prosecutor指公诉部所属的负责在当地对刑事案件提起公诉的检察官、公诉人，未必是王室检察官。

Crown Proceedings Act有的译为“王权诉讼法”，指1947年英国的政府诉讼程序法，公民一般可以在合同或侵权诉讼中对王室本身及其政府各部门提起诉讼，相当于我国的行政诉讼法。

pleas of the Crown也不是王室的控诉，而是指英国的刑事诉讼、公诉。

不过，Crown 的这种用法仅限于英国或适用英国法律的国家。美国英语里并不理睬这一解释，如The American Heritage Dictionary of the English

Language里，Crown词条的17条解释里竟然没有一条提到它可作criminal解。
